These Terms of Service ("Terms") govern your use of the Moonshot application ("App"), operated by Kikomedy GmbH, St. Gallen, Switzerland ("we", "us", or "our"). By using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. The App is not available where prohibited by applicable law. It is your sole responsibility to ensure that your use of the App complies with the laws of your jurisdiction, including any laws governing online wagering, real-money gaming, or interactions with digital assets.
Moonshot is a provably fair crash-style game built on the Solana blockchain. Each round generates a multiplier that grows over time and ends ("crashes") at a point determined by a publicly verifiable seed/hash chain. Players place a bet in SOL or SKR and may cash out (also referred to as "eject") at any time before the crash to lock in the current multiplier; if the round crashes before you cash out, the bet is lost. You connect your own Solana wallet via the Mobile Wallet Adapter to deposit, withdraw, place bets, and cash out. We do not custody your wallet keys and do not control individual round outcomes beyond operating the publicly verifiable fairness mechanism.
Round outcomes in Moonshot are randomly determined by a provably fair seed/hash chain that you can independently verify. Because outcomes are random, there is no guaranteed winning strategy and no guaranteed return. Placing a bet involves real financial risk: the round may crash at any multiplier — at the earliest at exactly 1.00x (an instant crash), never below — and any unredeemed bet is lost. You acknowledge that you may lose the entire amount you bet on any round, and you should never bet more than you are willing to lose.
Depending on your jurisdiction, participation in crash-style games with on-chain assets may be regulated, restricted, or prohibited. It is your sole responsibility to determine whether your participation is lawful where you reside and to refrain from using the App if it is not. We do not target users in jurisdictions where the App is unlawful and reserve the right to restrict access at our discretion.
You deposit SOL or SKR to your in-app balance, place bets at amounts you choose, and may withdraw your remaining balance to your connected Solana wallet at any time, subject to network conditions. All on-chain transactions (deposits, withdrawals, and any other transfers you sign) are final and irreversible once confirmed by the Solana network; we cannot reverse them under any circumstances. Bet settlement and cash out are processed by our game server against your in-app balance; once a round has resolved, the result is final.
A platform fee may be deducted from winnings or withdrawals to support operations; the current fee is displayed in the App at the time of the relevant action. You are responsible for Solana network fees on your own transactions and for any taxes arising from your use of the App or from any winnings.
SOL is the native asset of the Solana blockchain and is not issued by us. SKR is a utility token used for gameplay within the App. Neither SOL nor SKR is offered or marketed by us as an investment, security, or financial instrument. We make no representations about the value, liquidity, or future price of SOL, SKR, or any other digital asset. Any secondary market trading is done at your own risk and is outside our control. Nothing in the App constitutes financial, investment, tax, or legal advice.
Use of the App involves blockchain technology and cryptocurrency. You acknowledge and accept the risks including, but not limited to: price volatility of digital assets, transaction failures, network congestion, smart contract vulnerabilities, loss of private keys, irreversibility of confirmed transactions, and regulatory changes. We are not responsible for any losses resulting from these risks.
You connect your own Solana wallet to the App via the Mobile Wallet Adapter and remain in sole control of your wallet and private keys. We will never ask for your private keys or seed phrase, and we do not collect or store them. Any transaction you sign with your wallet — whether a deposit, withdrawal, or wallet-side approval — is considered authorized by you. Any loss of funds due to compromised wallet security, phishing, forgotten seed phrases, signing of unintended transactions, or other user error is your responsibility. You are responsible for reviewing each transaction prompt presented by your wallet before approving it.
You agree to use the App fairly. Multi-accounting to exploit promotions, abuse of bonuses, coordinated activity intended to manipulate the App or its economy, and any form of cheating are strictly prohibited. We reserve the right to investigate suspicious activity, suspend service to involved wallets, and take appropriate further action.
You may not use the App to: violate any laws or regulations; exploit bugs, vulnerabilities, or loopholes; engage in any form of cheating, collusion, or manipulation; use automated scripts, bots, or other unauthorized means; reverse engineer or tamper with the App; interfere with other users' enjoyment of the App; launder money or finance illegal activities; or circumvent geographical restrictions.
All content, design, graphics, code, and trademarks of the App are the property of the Moonshot operator or its licensors. You may not copy, modify, distribute, sell, or create derivative works without our prior written permission. The name "Moonshot" and associated logos are trademarks of the Moonshot operator.
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted, timely, secure, or error-free. We do not warrant that defects will be corrected or that the App is free of viruses or other harmful components.
To the maximum extent permitted by law, the Moonshot operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, tokens, or goodwill, arising from or related to your use of the App. Our total aggregate liability shall not exceed the fees paid by you to us in the three months prior to the claim, or CHF 100, whichever is greater.
You agree to indemnify, defend, and hold harmless the Moonshot operator, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney fees) arising from your use of the App, violation of these Terms, violation of any rights of another party, or violation of any applicable laws.
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, internet outages, Solana network congestion or halts, wallet provider outages, or third-party service failures.
We may suspend or terminate your access to the App at any time, without notice, for any reason, including violation of these Terms. You may also stop using the App at any time by disconnecting your wallet and ceasing further use. Provisions that by their nature should survive termination (disclaimers, limitations of liability, governing law) shall survive.
These Terms are governed by the laws of Switzerland, without regard to conflict of law principles. You agree to first attempt to resolve any dispute informally by contacting us at the address below. If the dispute cannot be resolved within 30 days, it shall be finally resolved by the competent Swiss courts. Nothing in these Terms prevents you from seeking mandatory consumer protection rights available in your country of residence.
We may update these Terms at any time. Changes will be posted at this URL with an updated date. Material changes will be announced through the App. Continued use of the App after changes constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Moonshot operator regarding the App.
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms at any time without notice.
